Civil Litigation and Claims

Mr. Berens and his law partners at Bailey|Onsager PC routinely engage in civil litigation in Washington State and Federal Courts on behalf of plaintiffs.  Recent favorable outcomes include prevailing in civil suits for: wrongful death on behalf of the estate of a Soldier killed in a shooting near Joint Base Lewis-McChord; medical malpractice against a Puget Sound Region hospital; wrongful death on behalf of family members against a county entity; negligence against the City of Seattle, and more.  Berens has also represented plaintiffs in federal employment law cases before the Merit Systems Protection Board.  Berens and his partners welcome the opportunity to advocate on behalf of clients pursuing civil claims.

Significant recent changes in federal law afford active duty service members the right to recover if they suffer an injury from a military health care provider.  These claims were previously denied through the “feres doctrine.”  Many military members had no recourse under the previous law.
